Terms of Use & Sale

These Terms govern use of terencioverde.xyz and purchases from Terencio Verde. By using the site or placing an order, you agree to these Terms. You must have the legal capacity to enter into the transaction; Terencio Verde does not impose a separate age restriction for ordinary apparel purchases.
1. Orders and Acceptance
Normal successfully paid orders may be accepted and processed in the ordinary course. Terencio Verde may decline, hold, or cancel an order before shipment for legitimate reasons, including suspected fraud, payment failure, inventory problems, obvious pricing or listing errors, shipping restrictions, legal or compliance concerns, or attempts to circumvent purchase limits. If Terencio Verde cancels a paid order, the appropriate refund will be issued.
2. Pricing, Availability and Quantity Limits
Terencio Verde may correct obvious pricing or listing errors and cancel and refund affected orders. If merchandise oversells or becomes unavailable, the customer may be offered a refund or, when feasible, the choice to wait for a restock or reproduction or select an agreed replacement. No substitution will be made without agreement.
Terencio Verde may establish reasonable per-person, per-household, per-order, or similar quantity limits, particularly for limited releases and collaborations. Orders intended to circumvent those limits may be canceled and refunded.
3. Product Appearance, Sizing and Limited Releases
Terencio Verde makes reasonable efforts to represent products accurately. Minor variations in color, dimensions, print or embroidery placement, materials, texture, and appearance may occur because of screens and normal production processes and do not by themselves constitute a defect.
Size charts and measurements are guidance. Fit may vary by garment and body type, and customers are responsible for selecting their size. Incorrect size selection does not automatically qualify for a refund.
Limited-edition and artist-collaboration releases may have additional collection-specific conditions disclosed on the applicable product or collection page before purchase. Those specific terms control where they expressly differ from these general Terms.
4. Preorders and Made-to-Order Products
Selected collections may be offered as preorders or made-to-order products. When applicable, the product page will identify that status and provide an expected fulfillment or shipping timeframe before purchase. Delays, cancellations, and refunds will be handled according to disclosed terms and applicable law.
5. Final Sales, Cancellations and Exchanges
Customer cancellation requests before shipment are considered case-by-case and are not guaranteed. Terencio Verde may consider whether production, customization, fulfillment, or shipping preparation has begun. Exchanges are also considered case-by-case at Terencio Verde's discretion and may be subject to item condition, availability, and shipping requirements.
For an ordinary discretionary exchange or other customer-requested return approved by Terencio Verde, the customer is responsible for return shipping unless Terencio Verde agrees otherwise. When Terencio Verde is responsible for a verified defective, damaged, or incorrect item, Terencio Verde will cover the appropriate shipping costs.
6. Defective, Damaged or Incorrect Merchandise
A defective, damaged, or incorrect item must be reported within 7 days after delivery, subject to any rights that cannot legally be limited. For a verified claim, the customer may choose a replacement, if available, or a refund. Terencio Verde may request reasonable evidence such as photographs of the merchandise, packaging, or shipping label to verify the problem.
7. Shipping and Delivery
Terencio Verde will provide an expected fulfillment or shipping timeframe. If a material delay occurs, customers will be notified and provided cancellation or refund options required by applicable law. Carrier transit and delivery dates are not guaranteed.
If a carrier confirms that a package was lost before delivery, the customer may choose a replacement, if available, or a refund. If tracking shows delivered but the customer reports the package missing, Terencio Verde will review the circumstances and may work with the customer and carrier; a delivered scan does not automatically guarantee a refund or replacement.
Incorrect or incomplete customer-supplied shipping addresses are handled case-by-case. Depending on the circumstances, Terencio Verde may reship, refund, replace, or require additional shipping charges.
8. Payment, Fraud and Chargebacks
Terencio Verde may hold, suspend, or cancel an order when payment is declined, fails authorization, is reversed, or is reasonably flagged for suspected fraud. Merchandise need not be shipped until required payment is successfully authorized. Terencio Verde may contest improper or fraudulent chargebacks and provide relevant order, payment, shipping, tracking, delivery, and customer-communication records to payment processors, banks, or card networks. Legitimate disputes and non-waivable consumer rights remain unaffected.
9. Taxes
Applicable sales or use taxes may be calculated and collected when required by law based on the transaction and delivery location. Taxes may be added at checkout rather than included in the advertised product price.
10. NFC and Interactive Apparel
The physical garment is the purchased product; supported digital functionality is an added feature unless a product or collection expressly states otherwise. Terencio Verde will make reasonable efforts to support interactive experiences but does not guarantee permanent availability or compatibility of any particular URL, website, platform, device, NFC technology, or third-party service. Discontinuation or change of a digital feature does not automatically make the physical garment defective, subject to applicable law and any express collection-specific promise.
If merchandise is specifically sold as NFC-enabled and the NFC component is defective when received, the customer may report it within the 7-day defect period and, after verification, choose a replacement if available or a refund. NFC failure caused by misuse, improper washing or care, physical damage, alteration, tampering, or failure to follow provided care instructions is not treated as a product defect.
NFC-linked content may be evolving or updateable, or a specific collection may promise fixed content. Any special commitment will be disclosed with that collection. NFC, serial numbers, tags, certificates, digital records, purchase records, or other methods may assist authentication, but no single feature is infallible. A damaged, missing, copied, or nonfunctioning NFC component alone does not establish that an item is genuine or counterfeit.
11. Intellectual Property and Collaborations
Terencio Verde retains its rights in its name, logos, trademarks, graphics, photographs, designs, website content, and other brand assets. Visiting the site or purchasing merchandise does not grant general commercial rights to those assets. Terencio Verde may expressly grant additional rights for a specific product, collaboration, promotion, or program.
Ownership and licensing of artist-collaboration artwork are determined by the applicable written artist agreement. Customers receive only the rights expressly provided with the product. For NFC-linked digital content, the default is ownership of the physical garment without ownership of underlying intellectual property; individual collections may expressly grant additional personal or commercial-use rights.
12. Customer Content and Reviews
Merely tagging, mentioning, or messaging Terencio Verde does not automatically grant Terencio Verde marketing rights to customer content. A designated submission feature, contest, campaign, or promotion may include a defined content license when those usage terms are clearly disclosed before submission.
Reviews may be moderated for legitimate reasons such as spam, fraud, profanity, threats, harassment, personal information, or irrelevant content. An otherwise legitimate review will not be removed or altered merely because it expresses a genuine negative opinion.
13. Promotions and Giveaways
Promotions, discount codes, sales, and giveaways may have specific eligibility requirements, expiration dates, exclusions, quantity limits, and rules concerning combination with other offers. Terencio Verde may correct or cancel a promotion affected by an obvious error, fraud, or abuse, subject to applicable law.
14. Resale, Counterfeits and Authenticity
Customers may generally resell physical Terencio Verde merchandise they legitimately own. Purchasing primarily for commercial or bulk resale or operating as an unauthorized reseller may be prohibited without Terencio Verde authorization. Resale does not make a seller an authorized Terencio Verde dealer or representative.
Terencio Verde may take appropriate action concerning counterfeit merchandise, unauthorized reproduction of protected designs or branding, false authenticity claims, and sellers falsely representing themselves as authorized dealers or representatives.
15. Third-Party Services
The site and interactive products may link to or integrate third-party services. Terencio Verde does not control or guarantee their availability, security, content, functionality, or independent policies. Use of those services may be governed by the third party's own terms and privacy policy. Nothing here eliminates obligations Terencio Verde itself has under applicable law.
16. Website Availability and Changes
Terencio Verde does not guarantee uninterrupted, continuously available, or error-free access to the site or digital features. Terencio Verde may maintain, modify, add, suspend, or discontinue features when reasonably necessary. Changes will not retroactively eliminate specific contractual rights or benefits expressly promised as part of a completed purchase.
17. Prohibited Use and Security
You may not use the site for fraud, impersonation, unlawful activity, distribution of malicious code, unauthorized access or security interference, disruptive automated abuse or scraping, circumvention of purchase limits, infringement of intellectual property, or interference with the operation of the site or services.
18. Disclaimers
Except for express product promises and rights provided by applicable law, the site, its content, and ancillary digital features are provided without additional promises or guarantees. Nothing in these Terms excludes or limits warranties, remedies, or consumer rights that cannot lawfully be excluded or limited.
19. Limitation of Liability
To the maximum extent permitted by law, Terencio Verde will not be liable for indirect, incidental, special, consequential, or similar losses arising from use of the site, third-party services, or ancillary digital features. This limitation does not apply where liability cannot legally be excluded or limited and does not eliminate remedies expressly promised for merchandise under these Terms.
20. Indemnification
To the extent permitted by law, you are responsible for losses, claims, or expenses resulting from your unlawful misuse of the site, fraud, infringement of another person's rights, or material violation of these Terms. This provision does not require you to indemnify Terencio Verde for Terencio Verde's own unlawful conduct or obligations that cannot legally be shifted to a customer.
21. Governing Law and Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where another jurisdiction's non-waivable consumer law applies. Disputes that cannot be resolved informally may be brought in a court of competent jurisdiction in Texas, subject to any venue or jurisdiction rights that cannot lawfully be waived. These Terms do not require mandatory arbitration or waive class-action rights.
22. Changes to These Terms
Terencio Verde may update these Terms prospectively. The version applicable to a completed purchase will not be retroactively rewritten to remove contractual rights already accrued. Material collection-specific terms disclosed before purchase remain applicable to that purchase.
23. General Terms
If any provision is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. Failure to enforce a provision on one occasion does not waive the right to enforce it later. These Terms, together with applicable product or collection terms and policies expressly incorporated into them, form the agreement governing the relevant use or purchase.
